The Government of Ontario proposed regulatory amendments

On October 7, 2021, the Government of Ontario proposed amendments to Ontario Regulation 422/17 (General) that directly impact the Ontario Immigrant Nominee Program’s (OINP) Employer Job Offer:

In-Demand Skills (EJO IDS) stream. According to the proposed regulations, employers seeking approval of a NOC 7511 (Transport truck drivers) employment position under the Employer Job Offer:

In-Demand Skills stream will have to be registered with Ontario’s Commercial Vehicle Operator’s Registration (CVOR) system, and have a Carrier Safety Rating (CSR) of Excellent, Satisfactory or Satisfactory-Unaudited.

The Government will also check employers’ business ties to the province since they will be required to have their vehicles plated in Ontario.

An applicant’s PR application will be reviewed by the decision of the Federal Court

Immigration, Refugees and Citizenship Canada rejected an applicant’s permanent residency (PR) application for the reason of not submitting the document as proof of completed degree.

The applicant, a former international student from the United Kingdom who came to Canada in September 2014 to complete a Master of Science degree at the University of Alberta requested a formal confirmation from the university, which IRCC later did not accept as proof.

The Federal Court of Canada decided that considering the wording on the IRCC website, it is unreasonable for IRCC to reject Express Entry (EE) applications if applicants provide other proof of education.

According to the decision of the court, IRCC must review the applicant’s EE application, taking into account the copy of the diploma issued by the university.

Canada completed issuing invitations under the Parents and Grandparents Program

From September 23 to October 4, 2021, the Government of Canada invited potential sponsors as well as those from the remaining pool of interest to sponsor forms submitted in 2020.

Eligible applicants have to check their email account since invitations to apply (ITAs) have been sent via email. Sponsors who received ITAs must submit their applications within 2 months.

The Government approved up to 40,000 applications — 10,000 of these applications were from the 2020 intake process, while 30,000 were from 2021.

Ottawa updated terms and definitions related to temporary residents

On October 4, 2021, the Government of Canada updated the terms and definitions related to temporary residents and also added terms relating to electronic travel authorization (eTA) and employer compliance.

In addition, the term “implied status” has been replaced with “maintained status” which is applicable for a temporary resident, who has a study or work permit, and applies to extend it before the expiration of that status and remains in Canada until a decision is made on the application.
